1. Acceptance of terms

Welcome to Crowd&Cult ("Platform," "we," "our," or "us"). By accessing or using the Crowd&Cult website, application, or any related services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Platform.

2. Platform overview & nature of services

Crowd&Cult operates as a digital marketplace and operating system connecting:

  • Hosts: Commercial venues, event promoters, and private individuals seeking to book talent and event infrastructure.
  • The Roster (talent and vendors): Independent musicians, DJs, live bands, sound and AV technicians, security personnel, and other event professionals.

We act strictly as an intermediary and facilitator. We are not an employment agency, employer, or event organiser. All booking arrangements are direct agreements between the Host and the respective Roster member.

3. Registration & vetting

  • Accuracy of information: Users must provide accurate, current, and complete information during registration and keep their profiles up to date.
  • Vetting process: Crowd&Cult reserves the right to review, approve, suspend, or reject any profile submitted to The Roster based on portfolio quality, technical riders, safety records, or other reasonable criteria.
  • Account security: You are responsible for safeguarding your credentials and for all activity that occurs under your account.

4. Bookings, escrow payments & fees

To reduce payment friction and protect both parties, eligible transactions are processed through an escrow flow operated by our payment partners:

  • Booking agreements: Upon confirmation of a booking, an automated digital booking record is generated between the Host and the Roster member capturing the agreed terms.
  • Escrow system: The Host's payment is captured upfront and held in a regulated, RBI-compliant flow via our payment gateway partners (for example Razorpay Route).
  • Payouts: Funds are released to the Roster member's linked bank account after successful completion of the gig, subject to platform verification, applicable holding periods, and the payment partner's settlement timelines.
  • Platform fees: Crowd&Cult charges a platform fee on successfully completed transactions (currently 10% on the Host side), along with any applicable subscription fees for commercial venues. Fees are non-refundable except where required by law.

5. Cancellations & the "SOS Panic Booking" backup

  • Host cancellations: If a Host cancels a confirmed gig within 48 hours of the scheduled start time, the escrowed amount may be forfeited and disbursed to the booked Roster member as a cancellation fee, in line with platform policy at the time of cancellation.
  • Roster cancellations & penalties: If a Roster member cancels a confirmed gig, they may face penalties including temporary or permanent suspension from the Platform.
  • SOS Panic Booking: Where available, Crowd&Cult's "SOS Panic Booking" flow aims to source a vetted replacement quickly (typically within ~30 minutes) in the event of a last-minute Roster cancellation. The Host is encouraged, where reasonable, to accept an automated replacement that matches the requested genre and technical specifications, subject to mutual agreement.

6. Independent contractor status & liability

  • Members of The Roster are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between Crowd&Cult and any user.
  • Equipment & damages: Crowd&Cult is not responsible for damage to a venue's property, or to a Roster member's equipment or sound systems, during an event. Such disputes must be resolved directly between the Host and the Roster member, with Crowd&Cult assisting only as a facilitator where appropriate.

7. Intellectual property

All content, design, text, graphics, algorithms, and interfaces on the Platform are the property of Crowd&Cult or its licensors. Users retain ownership of the portfolios, media, and promotional materials they upload, and grant Crowd&Cult a non-exclusive, worldwide, royalty-free license to host, display, and use those materials to operate and promote the Platform, including in search results, discovery features, and marketing.

8. Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Indian Contract Act, 1872. Subject to applicable consumer protection laws, any disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra.

9. Modifications to terms

We may update or modify these Terms from time to time. We will indicate the date of the latest revision at the top of this page and may provide additional notice for material changes where appropriate. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
